What is Mediation?
Mediation is utilized to bring two sides of a dispute together to give them an opportunity to find common ground that may have already existed, but was camouflaged by misunderstanding, anger or fear. The mediation process utilizes a neutral third party who does not judge the case but helps facilitate a discussion between the parties. The mediator identifies and helps to define the issues, and then puts them in perspective in an attempt to resolve the dispute. Mediation is less expensive, more confidential, and highly effective in resolving conflicts, without the unpleasant experience which is often associated with taking a case to trial. Mediation is recognized by the judiciary as an invaluable tool that benefits all parties in contrast to potentially litigious court battles. As a result, many more judges are ordering parties to mediation in an attempt to settle their dispute prior to going to court. This, along with other factors, makes mediation a more popular method to remedy some of the shortcomings of litigation.
The standard fee for mediation services is $300.00 per hour with a mandatory 2 hour minimum.
